The following terms and conditions apply to anyone accessing and using the Handylocals.com website or any part of it. Handylocals.com may modify these conditions from time to time and accordingly you are advised to keep up to date with the changes by regularly reviewing them. By using the directory you agree to be bound by these conditions.
This Agreement also includes our Privacy Policy and Disclaimer. Together they contain the whole of the agreement between us and you concerning the Handylocals.com Service and they replace all earlier agreements and understandings with you, except for any fraud or fraudulent representation by either of us.

By using or subscribing to our site you enter into a binding contract with us on the following terms and conditions.
3. Subscription rates
3.1 This service is provided on an annual subscription basis using a secure transaction service provided by PayPal©, or by cheque. The subscription rate will be clearly displayed on the Handylocals options page. You may choose to continue or not at this point.
3.2 The minimum subscription period is 12 months.
3.3 You can cancel your subscription at any time prior to the day on which your subscription payment is due. This can be done using the Handylocals options page. No refunds or partial refunds will be given.
3.4 By subscribing to our site, you agree to pay our charges at the rate applicable from time to time, details of which can be located on the Handylocals options page.
3.5 If you fail at any time to pay any subscription charges due in accordance with these terms and conditions we may, in our discretion and without prejudice to our other rights, deny you access to those areas of our site which are exclusively available to subscribers. We need not provide you with advance notice in such circumstances.
4. Termination of subscription
We may terminate your subscription immediately if you are in material breach of any of these terms and conditions and in particular upon any failure by you to pay your subscription charge in accordance with these terms and conditions.
5. Links to other sites
Certain links, including hypertext links, in our site will take you outside our site. Links are provided for your convenience and inclusion of any link does not imply endorsement or approval by us of the linked site, its operator or its content. We are not responsible for the content of any website outside our site.
6. Registration
6.1 You undertake to advertise with Handylocals.com using accurate and current information about yourself Ð including your correct name, address and any other requested details.
6.2 Where payment is handled by PayPal© you must also agree to their terms and conditions.
6.3 When you are asked for, and provide, details of a credit, debit or charge card you must ensure that (a) you are fully entitled to use that card, and (b) it has available funds sufficient to cover the subscription charge.
6.4 If you pay by credit or debit card, as part of the registration process for Handylocals.com , you will receive a verification email from PayPal©, the purpose of which is to take reasonable steps to ensure that the email address you have nominated during registration is controlled by you. That email contains simple instructions which you must follow.
7. Keeping your details up to date
7.1 It is important for us and your customers to have correct contact information.
7.2 It is your responsibility to keep this information up to date.
7.3 You can update your details at any time using the Handylocals options page.
8. The renewal process
8.1 The minimum subscription period is 12 months.
8.2 A renewal notice will be sent 1 month before your subscription is due.
8.3.1 If you paid using PayPal: the renewal notice will give you the option to unsubscribe up to the day before your renewal payment is made. Please note: if you unsubscribe, your advert will not be removed until the renewal date.
8.3.2 If you paid by cheque: please send us payment for another year's susbscription prior to your renewal date. Failure to do so will result in the suspension of your advert.
8.4 If you paid using PayPal: if you do not unsubscribe the payment will automatically be billed to your credit/debit card used for your previous payment at the current subscription rate. Please ensure that it has available funds sufficient to cover the subscription charge.
8.5 Any change in annual subscription rate will be clearly displayed on the Handylocals options page.
9. Suspension or removal of advert
9.1 Handylocals.com reserves the right to suspend or remove any advert that is illegal or in breach of current advertising standards. It is the advertiser's responsibility to ensure conformity with all current legislation relating to advertising and trading standards.
9.2 There will be no refunds for suspended or removed adverts although we will endeavour to resolve the issue with the advertiser.
10. Customer feedback information for advertisers
One of the key features of Handylocals.com is to build on the "word of mouth" process of customer recommendation. As an advertiser you may find it beneficial to ask your customers to log on to the website after using your service, to give feedback.
- The system is based on one question, "Would you recommend this service?"
- The results will be presented as part of your advertisement.
- Handylocals.com reserves the right to revise the feedback system at anytime.
- The feedback system will be monitored and may be revised if deemed necessary in the future.
11. General user
11.1 Handylocals.com is provided on an 'as-is' basis.
11.2 The purpose of Handylocals.com is for finding goods and services only.
11.3 Handylocals.com does not warrant or guarantee the accuracy or completeness of adverts. It is your responsibility to judge the accuracy or completeness of the content of an advert before relying on it in any way. Your use of the content (for whatever purpose) is at your sole risk.

11.5 You are advised to read our guidance notes before using the services of a Handylocal.
12. Customer feedback information for general users
One of the key features of Handylocals.com is to build on the "word of mouth" process which we all use from time to time in order to choose a product or service. We would encourage you as a customer of the advertisers to return and let us know if you would recommend the Handylocal you have used.
- The feedback system is based on one question, "Would you recommend this service?"
- The feedback figures presented in relation to individual advertisers are intended to give additional guidance only, when choosing services.
- The feedback system will be monitored and may be revised if deemed necessary in the future.
13. Exclusions and limitations
13.1 We do not represent or warrant that access to our site, or any part of it will be uninterrupted, reliable or fault free.
13.2 We do not represent or warrant to you that our site or any of its contents will be accurate, complete or reliable.
13.3 We do not represent or warrant that any services (whether or not provided by us) will be provided with due care and skill.
13.4 To the extent permitted by law, we exclude all liability (whether arising in contract, tort or otherwise and whether or not due to our negligence) which we may otherwise have to you as a result of:
13.4.1 any technical, factual, textual or typographical inaccuracies, errors or omissions on or relating to our site or any information on our site;
13.4.2 the unavailability of our site (or any part of it);
13.4.3 any delay in providing, or failure to provide or make available services or any negligent provision of services;
13.4.4 any misrepresentation on or relating to our site or the services (other than a fraudulent misrepresentation made by us on our behalf).
13.5 Our maximum liability to your business in respect of your use of our site or any services we provide or make available to you through or in relation to our site will be the amount of any subscription fees paid on behalf of your business during the year in which the liability arose. You agree that we shall have no liability for indirect or consequential losses, loss of data, income or profits or damages for loss of or damage to property.
13.6 None of the above exclusions shall affect any statutory rights which are not capable of being excluded. However, in such case our obligation, where permitted by law, will be limited to the re-supply of our site or service to you.
13.7 Each of the above exclusions or limitations shall be construed as a separate, and severable, provision of these terms and conditions.
14. General
14.1 Third party rights
14.1.1 Subject to clause 14.1.2, a person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of this Agreement.
14.1.2 Where in these terms representations and warranties are made to us and to suppliers of goods and services through our site, you acknowledge and agree that such representations and warranties are intended to grant rights to, and operate for the benefit of, all such suppliers and that each supplier may rely upon and enforce such representations and warranties against you by virtue of the Contracts (Rights of Third Parties) Act 1999.
14.2 Variations
We reserve the right at any time without notice to revise the content of our site (including the services offered by us) and these terms and conditions will be posted on our site and by continuing to use our site following any such change you will signify that you agree to be bound by the revised terms and conditions of use.
14.3 Taxes
We have made every effort to make clear whether the quoted prices for goods and services available through our site include any relevant tax or duty or do not. Where in any case it is not clear please note before you make an order that you might be required to bear a liability to tax or duty (for example value added tax) imposed by the supplier or by operation of law that is in addition to the price.

15.2 You are entitled to use any data and information provided by Handylocals.com for your own personal use. However, you are prohibited from using for business purposes or commercial gain, any of the information on our website, as a directory for any form of telemarketing, direct marketing or marketing by way of electronic means.
15.3 Any data and information provided through Handylocals.com pages, including the software used e.g. images, logos and intellectual property remains the property of Handylocals.com.
